A tilted extension ladder, side rails that stop below the landing surface, a worker carrying tools instead of using a hoist — each one is a same-day citation and each one is preventable by a designated competent person walking the site before the crew mobilizes.

This post is written for construction site supervisors, superintendents, and foremen who own portable ladder compliance on active jobsites. Why Ladders Produce Faster Citations Than Almost Any Other Standard

Fall protection citations under 1926.501(b)(13) require the CSHO to observe a worker exposed to a fall hazard at 6 feet or more. Ladder citations under 1926.1053 do not. The standard’s provisions are documentary and physical — a ladder either has 3 feet of side-rail extension above the landing surface or it does not, a fixed ladder installed after November 19, 2018 either has a ladder safety system or it does not. The most-cited 1926.1053 provisions in the current enforcement cycle:

  • 1926.1053(b)(1) — Side rail extension. Portable ladders used to access an upper landing surface must have side rails extending at least 3 feet above the upper landing. Where the extension is not possible, the ladder must be secured at its top and a grasping device must be provided.
  • 1926.1053(b)(4) — Ladders on stable surfaces. Ladders must be used only on stable and level surfaces unless secured to prevent accidental displacement.
  • 1926.1053(b)(6) — Weight rating. Non-self-supporting ladders must be used at an angle where the horizontal distance from the top support to the foot of the ladder is approximately one-quarter of the working length (roughly 75.5°). Self-supporting ladders must have spreaders locked in the open position.
  • 1926.1053(b)(15) — Ladder condition. Ladders with structural defects must be immediately marked defective or tagged with “Do Not Use” and withdrawn from service until repaired or replaced.
  • 1926.1053(a)(19) — Fixed ladders over 24 feet. Any fixed ladder installed on or after November 19, 2018 and extending more than 24 feet must be equipped with a personal fall arrest system or a ladder safety system. Cages and wells no longer satisfy the standard for new installations, and every fixed ladder installed before that date must be retrofitted by November 18, 2036.

The last provision — the 2036 retrofit deadline for pre-2018 fixed ladders — is the single provision most site supervisors do not know about. A CSHO documenting a pre-2018 fixed ladder over 24 feet with only a cage installed is closing the citation on the retrofit deadline, not on the original installation date.

The Credential That Makes Ladder Enforcement Defensible

The 24-Hour Fall Protection Course For Advanced Scopes

Not every fall protection scope is covered by the Competent Person course. Scopes involving personal fall arrest system (PFAS) design, engineered anchor-point specification, leading-edge work, and rescue coordination require deeper technical training and are best served by the 24-Hour Fall Protection course.

The 24-Hour course is the right path when:

  • The site includes leading-edge work, tower construction, wind-turbine installation, or telecommunications tower work where the competent person also designs or approves PFAS configurations.
  • The scope of work requires the competent person to perform rescue coordination beyond assisted self-rescue, including suspended-worker retrieval within OSHA’s 6-minute suspension trauma threshold.
  • The employer’s fall protection program requires the competent person to author or approve site-specific fall protection plans under 1926.502(k).

Caveat: the 24-Hour Fall Protection course is a substantial time commitment. For competent-person designation on routine ladder and standard fall protection scopes, the 8-hour Competent Person course is the appropriate and cost-effective baseline.

Renewal And Currency Requirements

The Fall Protection Competent Person credential does not carry a federal expiration date. Retraining is triggered by events, not by time — and the trigger events matter more than the calendar:

  • No incidents; equipment and procedures unchanged: No federal retraining trigger. Most employer policies require refresher training every 3 years for the designated competent person. Cost is limited to internal policy compliance.
  • New PFAS equipment introduced, or a change in the type of fall protection used on-site: Under 1926.503(c), retraining is required when the inadequacies in a worker’s knowledge suggest the worker has not retained the requisite understanding. Introduction of new equipment types is the most common trigger.
  • A near-miss or documented incident: Full retraining of the competent person and every affected worker is the defensible baseline. Under 1926.503(c), retraining is required whenever workplace changes or worker knowledge inadequacies indicate the training was inadequate.

Legally required vs. recommended: Fall Protection Competent Person is the credential that documents 1926.32(f) competent-person authority for the fall protection standard. The Recommended Sequence For A Q3 Ladder Compliance Audit

Most construction operations reading this post are running active summer scopes with heavy portable-ladder use and have not documented a competent-person designation for the specific supervisor authorizing that use. The following sequence closes the gap in less than two weeks:

Sequence:
